SECTION 2 – PLATFORM SERVICES
VukaGo provides a trade-only business-to-business (B2B) digital marketplace and booking platform that
connects travel agents, tour operators, destination management companies, accommodation providers,
transport providers, activity operators, guides, and other tourism suppliers.
The platform enables registered users to search, compare, request, book, manage, and pay for tourism
products and services offered by independent Suppliers.
All product descriptions, pricing, availability, inclusions, exclusions, images, and other information
displayed on the platform are provided by Suppliers or obtained from third-party sources. While VukaGo
endeavours to maintain accurate information, VukaGo does not warrant the accuracy, completeness, or
availability of any Supplier content.
VukaGo reserves the right to modify, suspend, restrict, or discontinue any feature, service, supplier listing,
booking functionality, or platform capability at any time.
SECTION 3 – ELIGIBILITY, ACCOUNT REGISTRATION AND VERIFICATION
Access to VukaGo is restricted to legitimate travel businesses and tourism industry professionals.
By registering for an account, you represent and warrant that:
• You are acting on behalf of a legitimate business entity;
• You possess the authority to bind that entity to these Terms;
• All information provided during registration is accurate and complete; and
• You will maintain accurate and up-to-date company information at all times.
VukaGo reserves the right to request business registration documents, tax registration certificates, proof
of address, identification documents, licensing information, and any other information reasonably
required for compliance and verification purposes.
VukaGo may refuse, suspend, or terminate access to any account at its sole discretion.
SECTION 4 – BOOKINGS, REQUESTS AND CONFIRMATIONS
Booking requests submitted through the platform do not constitute confirmed reservations until accepted
by the relevant Supplier and confirmed through the platform.
Availability displayed on the platform may change without notice.
A booking shall be considered confirmed only when:
• Availability has been verified;
• Required information has been provided;
• Payment requirements have been satisfied; and
• Confirmation has been issued through the platform or by the Supplier.
Buyers are responsible for reviewing all booking details and notifying VukaGo of any discrepancies as soon
as reasonably possible.
SECTION 5 – PRICING, COMMISSIONS AND PAYMENT
Prices displayed on the platform are subject to change until a booking has been confirmed.
Supplier pricing may change due to exchange rates, government levies, taxes, fuel surcharges,
conservation fees, supplier pricing updates, or operational requirements.
VukaGo may charge commissions, booking fees, platform fees, technology fees, subscription fees,
transaction fees, or other service charges for use of the platform.
All fees and charges applicable to a transaction shall be disclosed prior to confirmation where reasonably
practicable.
Failure to make payment by the required deadline may result in cancellation of bookings, suspension of
services, or account restrictions.
SECTION 6 – MARKETPLACE STATUS, SUPPLIER RESPONSIBILITY AND TAX COMPLIANCE
VukaGo acts as a technology platform and intermediary facilitating transactions between Buyers and
Suppliers.
Unless expressly agreed otherwise in writing, VukaGo does not own, operate, control, manage, or deliver
the tourism products and services listed on the platform.
Suppliers remain solely responsible for:
• Delivery of their services;
• Accuracy of content, pricing, and availability;
• Compliance with licensing requirements;
• Insurance obligations;
• Consumer protection obligations;
• Tax compliance; and
• Compliance with all applicable laws and regulations.
Buyers and Suppliers remain responsible for their own tax obligations, including VAT, GST, withholding
taxes, tourism levies, and other statutory obligations applicable in their jurisdictions.
VukaGo reserves the right to collect, verify, store, and disclose information required for tax, regulatory,
anti-money laundering, know-your-customer, fraud prevention, sanctions compliance, and legal reporting
purposes.
SECTION 7 – SUPPLIER WARRANTIES
Suppliers warrant that:
• They have the legal authority to provide the services listed on the platform;
• They possess all required licences, permits, approvals, and registrations;
• They maintain all legally required insurance policies;
• Their content and pricing are accurate and lawful; and
• Their services comply with applicable laws and industry standards.
Suppliers shall indemnify and hold harmless VukaGo against claims arising from inaccurate listings, service
failures, regulatory breaches, licensing issues, tax non-compliance, or negligent conduct.
SECTION 8 – LIMITATION OF LIABILITY
VukaGo acts solely as an intermediary platform and shall not be liable for any act, omission, negligence,
insolvency, overbooking, cancellation, injury, loss, delay, property damage, service interruption,
regulatory breach, or contractual failure by any Supplier or Buyer.
To the fullest extent permitted by law, VukaGo’s liability arising from any transaction shall be limited to
the amount of fees directly received by VukaGo in connection with the transaction giving rise to the claim.
SECTION 9 – DISPUTES BETWEEN USERS
Any dispute relating to the underlying tourism service shall be addressed directly between the Buyer and
the Supplier.
VukaGo may, at its discretion, assist in facilitating communication between the parties but shall not be
obligated to resolve disputes or provide compensation.
SECTION 10 – FORCE MAJEURE
VukaGo shall not be liable for delays, failures, interruptions, cancellations, or losses resulting from events
beyond its reasonable control, including natural disasters, severe weather, epidemics, pandemics,
government actions, border closures, labour disputes, cyber incidents, infrastructure failures, political
unrest, supplier insolvency, or other force majeure events.
